Legalising Drugs in India

Sameer Wankhede, the Area Director of NCB Mumbai, our own James Bond (as the TV media would like to project) apparently only seized 13 grams of cocaine, 21 grams of charas and 22 MDMA tablets from the cruise ship on which Khan was arrested. As for this raid, the boastful gestures of the NCB chief on national television sound like the army chief of staff announcing to the world that he will catch the thief who stole food from a colleague`s tiffin box. We remember the famous British officer Norman Pilcher, who pinned many celebrities, such as members of the Rolling Stones and the Beatles, for drug possession. Pilcher used fraudulent means to loot and slander them on drug charges to satisfy tabloid news, which he admitted in his memoirs. 18. In October 1968, wearing a postman`s hat, Pilcher rushed into John Lennon and Yoko`s Marylebone apartment and discovered that “they were naked!” Portugal has experienced one of the worst drug epidemics in the world. This prompted the government to take the next step. In 2001, all drugs (including heroin) were decriminalized. Drug possession and use were treated as health problems, not crimes. Anyone caught with less than ten days of drugs – including heroin – received mandatory medical treatment.

Without a judge, no courtroom and no prison, the number of drug addicts, hard drug use and disease have decreased due to exaggerations. Printable version| 20. The list uses the International Nonproprietary Name (INN) of the medicines, but in some cases refers to the medicines by their chemical name. Widely known drugs such as ganja, cocaine, heroin, etc. are mentioned under these names. Later, in 2015, the first organized efforts to relegalize cannabis in India appeared, with medical marijuana conferences held in Bangalore, Pune, Mumbai and Delhi by the Great Legalization Movement of India. Many articles and programs in popular media have also begun to push for a change in cannabis laws. In addition, Lok Sabha MP Dharamvir Gandhi announced in 2016 that he had received permission from parliament to introduce a bill to amend the NDPS Act. Later in 2019, the Delhi Supreme Court agreed to hear a petition from the Great Legalisation Movement Trust challenging cannabis prohibition.

The public interest litigation argues that the bundling of cannabis with other chemical drugs under the HNS Act is “arbitrary, unscientific and unreasonable.” Earlier, on October 13, Aryan Khan`s lawyer, Amit Desai, argued in favour of the bail application for Shah Rukh Khan`s son, citing numerous penalties related to seizing a small amount of drugs and highlighting some points regarding the motive of laws and some of international practices. Desai said many countries have removed cannabis from the list of dangerous drugs. But when the pandemic led to a sharp increase in global drug use, according to UNODC`s (United Nations Office on Drugs and Crime) World Drug Report 2021, buyers and sellers quickly overcame initial lockdown restrictions. Advances in communications technology, e-commerce and digital payments have facilitated the expansion of operations and circumvention of the law. In India, the Narcotic Drugs and Psychotropic Substances Act 1985 (NDPS) prohibits the production, possession and sale of the best-known drugs, including weed, known locally as ganja (the “flowering or fruiting spikes of the cannabis plant”) or charas (the resin that also produces hashish). And in a world that increasingly requires us to live our lives online, a particular kind of resilience has permeated their urban drug networks – where technology has been both a blessing and a curse for everyone involved. Although there was talk of purchasing medicines, it was suggested that “trade in any activity in” should be replaced by “agreement” to improve clarity. Bollywood actress Ananya Panday appeared outside the drug control bureau in Mumbai for the second day in a row on Friday and was interrogated for nearly four hours as part of her alleged WhatsApp chats with Aryan Khan, son of superstar Shah Rukh Khan, who was arrested in a drug case.

NCB sources told PTI. The proposal seeks to further the decriminalisation of personal use by amending Article 39 as well as simultaneous amendments to Articles 15, 17, 18, 20, 21 and 22 of the Narcotic Drugs, Drugs and Psychotropic Substances Act 1985 (NDPS), which deals with the supply, use and financing of drugs.
