Rules for Shooting Guns on Your Property

So if you live outside the city limits, chances are you`ll be able to shoot your weapons on your land as long as you meet the space requirements. However, if you live within the boundaries of a city of less than 100,000 people, you`ll need to check your local regulations to discharge a gun before firing a gun into your backyard. Since we`ve been in Texas, many of us love the Second Amendment and wish we could shoot our guns in our backyard. But will that land you in jail? The Act states that a municipality may not regulate the unloading of a shotgun, rifle or air pistol, BB pistol or bow and arrow within the “extraterritorial jurisdiction” of the municipality if: you are located on land of at least 10 hectares; and you are more than 150 meters from the residence or building inhabited on the neighboring property; and you are not discharging the firearm in a way that it can reasonably be expected to cross the border of the country. This is the unincorporated area of a county; the area outside the city limits. This means that if you are outside the city limits and have a lot of at least 10 acres, you are allowed to shoot a shotgun, air rifle or pistol, BB pistol or bow and arrow as long as you are 150 feet from your neighbor`s house. If you`re outside the city limits and have at least 50 acres of land and 300 feet from your neighbor`s house, you can shoot a rifle or traditional pistol at your property. However, the law allows municipalities to regulate the surrender of firearms within city limits. This means that if you live within the city limits, you may not be able to fire a gun on your property, even if you meet the space requirements. Under section 42.12 of the Texas Criminal Code, it is a crime to recklessly discharge a firearm within the boundaries of a community of 100,000 or more people. A crime under this law is a Class A offense, meaning it carries a sentence of up to a year in jail in the county, a $4,000 fine, or both.
