For more than a century, the LSE has pioneered legal education and academia as a central part of its mission. But it was law as a practical discipline—the rules and methods by which society and economics are regulated—shaped by the social sciences. The contrast with the Oxford tradition was striking, with emphasis on investigating referral cases to the exclusion of legislation. The LSE dared to be different and played an important role in developing the academic study of subjects such as commercial law, labour law, tax law, family law, human rights law and public law. Concerns about the legislation have been driven by deeper theoretical and political motives. As Professor Sir Otto Kahn-Freund explained in a lecture in 1972, the reason for the development of new subjects at the LSE was that its researchers promoted “a conception of law as a social technique”, a process that illustrated “the course of the functional treatment of law”. Driven by a programme that examined the social forces that made the law and the formative effect of law on society, LSE researchers were more interested in normal processes than pathological cases, the mundane rather than the superrational, and the general functioning of public policy rather than a limited focus on judicial proceedings.
