Critical Race Theory Harvard Law

When he returned to Harvard in 1986, after a year-long stint at Stanford University, Bell staged a five-day sit-in at his office to protest the school`s inability to provide employment for two professors whose work both promoted critical racial theory. [1] The sit-in was widely supported by students, but divided the faculty because Harvard administrators claimed that the professors had been denied employment for lower scholarships and teaching. [15] On September 1, 2020, conservative journalist and researcher Christopher Rufo went to Fox News to condemn anti-bias training in federal agencies as an example of critical racial theory. Rufo described the CRT as a radical ideology that sows racial segregation through education. [9]. The term “ongoing struggle” refers to the ongoing efforts of students and academics to teach CRT in law schools and other disciplines. Since 2020, Conservatives across the country have launched a coordinated campaign against CRT, falsely claiming that it is taught in K-12 schools. These campaigns quickly degenerated into state legislation. For example, at the time of writing, at least thirty-six states have introduced some sort of legislation prohibiting CRT or discussions about race and racism from being taught in K-12 schools and, in some cases, universities. March 2022); see also Cathryn Stout & Thomas Wilburn, CRT Map: Efforts to Restrict Teaching Racism and Bias Have Multiplied Across the U.S., Chalkbeat (February 1, 2022, 7:20 p.m.) www.chalkbeat.org/22525983/map-critical-race-theory-legislation-teaching-racism [perma.cc/3R93-G2ZP]. In response, the predominant counter-narrative to these efforts has been that CRT is taught primarily in law schools rather than in K-12 environments. Both accounts are inaccurate.

While it is true that K-12 schools have not explicitly adopted the CRT teachings, the CRT has been adopted in the master`s and doctoral programs in education, humanities and social sciences. See, for example, About Us, Critical Race Studies in Educ. Ass`n, www.crsea.org [perma.cc/75BS-2466]. At the same time, contrary to popular discourse, the majority of law schools do not teach CRT. Although law schools have not issued bans against the CRT, contrary to a statement by the Association of American Law Schools, law schools have not made a conscious and consistent effort in the past to cultivate CRT programs and academics outside of a few programs in the country. In fact, some states are considering preventing CRTs from being taught in their state colleges. Therefore, the search for crT in all education systems remains a constant struggle, widely supported by students and some scientists. What she experienced was a reduction in white supremacy after a short window of progress in black civil rights. “To the extent that anti-discrimination law is supposed to include color blindness,” Crenshaw wrote, the rhetoric of equal opportunity represents a formidable obstacle to efforts to mitigate the conditions of white supremacy.

In many ways, she argued, color blindness has only improved white supremacist politics and culture. Kimberlé Williams Crenshaw has made it clear that she believes a reaction is taking place right now after the global protests against the killing of George Floyd by the police. That is why, according to them, there is an institutional campaign against critical racial theory. When she wrote “Race, Reform, and Retrenchment” (Harvard Law Review (1988)), she believed a similar process was underway. [51].
