There are a number of steps you need to follow if you want to use your rent to pay for repairs. This procedure will probably only be useful for minor repairs that you can afford if necessary. The right of retention does not mean that you have the right to live without rent in your apartment.
Rent deduction is a way to get the landlord to make repairs. Once a landlord makes repairs, you need to start paying the rent again. You have the legal right to repair everything in your apartment or in the common areas of your building. If there are violations that affect several apartments or an entire building, a group of tenants can sit together and have the repairs done. However, make sure everyone agrees that you have a certified health report documenting the issues and that you have notified your landlord in writing of the violations. Each tenant can then deduct up to 4 months` rent for his share of the total amount. According to the law, you can only deduct a total of 4 months` rent over a 12-month period. You cannot store the retained rent for months for several years and then deduct more than 4 months` rent in a single year. If you opt for repair and deduction, you will record all invoices and receipts for material and work as proof of your costs.
Remember: when you perform the repair, you take responsibility for making sure it is done correctly. If you hire someone to perform the repair, ask what complications or risks may arise during the repair. It`s also a good idea to get a reference for all the people you hire and some estimates for the work so you can show that the cost of the person you hire is reasonable, but in some circumstances, a tenant can pay for the repairs and deduct the cost from future rent. Using rent in this way can be faster than court proceedings and avoids legal fees for both the tenant and landlord. If the landlord does not pay, the tenant can deduct the cost of the repair work from the future rent It is important to note that only the cost of the repairs required under section 11 of the Landlords and Tenants Act 1985 can be deducted from the rent. All other deductions, such as remuneration for work not performed on time, are not covered by law and must be mutually agreed between the parties (preferably in writing). If you`re waiting for repairs or arguing with your landlord or landlord about other issues, you`ll still have to pay your rent as agreed. If you think your rent or rent increase is too high, you can discuss this with the Rent Assessment Committee, which will review what you will be charged and decide whether you have a case or not. If your landlord doesn`t respond or continues to refuse to do the necessary work, you may want to write again. You might suggest using a portion of your next rental payment to pay for repairs. When you do this, you need to make sure that you can have a rent increase, and while landlords and rental agents have every right to do so, there are rules that govern when and how it is done. The rent increase must not exceed a reasonable amount, which is largely dictated by the local market.
Remember when we said, “Never withhold your rent,” it`s not 100% fair. There are certain circumstances in which a tenant can pay for repairs that were not done by the landlord and deduct the cost of those repairs from future rent. However, it is not easy, there is a process that must be followed. A clause in a lease that says you can`t use the rent to pay for repairs is likely unfair and could be challenged. Tenants have the right to withhold rent as landlords are required to provide safe and habitable housing under the guarantee of habitability. If a landlord fails to meet this obligation, a tenant`s obligation to pay the full amount of rent ends until repairs are made.45 A tenant may want to withhold all or part of the rent, depending on the severity of the violations.46 The law does not specify how much or how long you can withhold.
